Adamawa: Tribunal upholds Binos, Kwamoti, Namdas’ elections

 

The State and National Assembly Election Petition Tribunal sitting in Yola has upheld the election of Senator Yaroe Binos Dauda of the Peoples Democratic Party (PDP) representing Adamawa South senatorial district.

The tribunal presided over by Justice Sulaiman Akanbi Thursday decided on the matter which had challenged the validity of the election of the senator and two members of the House of Representatives: Hon Bitrus La’ori Kwamoti and Abdulrazak Namdas.

The tribunal dismissed the petition filed against the senator (Dauda) by the immediate past senator that represented the senatorial district, Mohammed Abubakar Moallayidi, of the All Progressives Congress (APC). 

Delivering judgement on the matter in Yola, Justice Akanbi dismissed all the 10 issues raised by the petitioner against Senator Binos Dauda for lack of evidence and merit. 

The judge explained that the petitioner failed to prove his case with concrete facts and evidence but had relied on speculations and hearsay which he said have no place in law.

He, therefore, dismissed the case and upheld the election of Senator Binos as the duly elected representative of Adamawa South senatorial district at the National Assembly. 

Reacting to the judgement in an interview with journalists in his Yola residence Senator Binos Dauda said the judgement did not come to him as a surprise because he won his election in a free and fair contest. 

He said his election represents the will of the people of Adamawa South, stressing that even if they go to one million courts he will still win.

The senator assured the people of credible representation at the senate noting that the court victory would encourage him to do more for his people. 

Similarly, the tribunal upheld the election of Hon Kwamoti La’ori of the PDP representing Numan/Demsa/Lamurde federal constituency and dismissed the petitions against him.

All progressives Congress candidate, Mrs Ovaldi Madayi, had challenged the victory of the former Deputy Speaker and one-time member of the House of Representatives, Laori Kwamoti, alleging massive irregularities in the processes leading to his election.

She had therefore challenged the validity of the Independent national Electoral Commission’s declaration of La’ori winner of the February 23 election.

But Justice Akande found no merit in the arguments and evidences presented by council to Mrs Madayi and subsequently dismissed the suit for want of merit and failure to prove its arguments beyond reasonable doubt.

Delivering judgement on Abdulrazak Namdas’ case, the tribunal ruled that the PDP candidate failed to prove his allegations of inconclusive election, adding that even the video clip presented before the tribunal was vague. 

Malam Mucthar Kabiru of the PDP had challenged the victory of Representative Abdulrazak Namdas of the APC for Ganye/Toungo/Jada/Mayo-Belwa federal constituency. 

But the judge after listening to verbal arguments and examination of the respondents as well as their adopted written addresses dismissed the case and thus authenticate Namdas’ election.
