Bilyamin murder: Court hears bail application Thursday

Justice Yusuf Halihu of a Federal Capital Territory High Court, Jabi, Abuja, will on Thursday, December 7, hear the bail application on the case of Maryam Sanda, who was accused of stabbing his husband, Bilyamin Bello to death.
The alleged husband-killer was arraigned before the court and remanded in Suleja prison, on a two-count charge of culpable homicide for allegedly stabbing Bilyamin to death on November 19, in their home at 4, Pakali Close, Wuse Zone II, Abuja.
The offence, according to the Police is a culpable homicide punishable by death under section 221 of the Penal Code Law.
Sanda was alleged to have stabbed the late husband in the chest with a broken bottle.
The prosecution also alleged that the defendant caused the deceased “grievous hurt” by stabbing him on the neck.
The offence is said to be contrary to section 240 (g) and punishable under section 247 of the Penal Code Law.
She pleaded not guilty to the charges.
Sequel to the not guilty plea, the defence counsel, Mr. Oseni Musa, made an oral bail application on behalf of the defendant.
In his plea, he submitted that the defendant who is a nursing mother of an infant of less than six months, should be remanded in police custody pending the determination of her bail application.
The prosecuting counsel, Mr. James Idachaba, opposed the oral application.
He further informed the trial judge that the charges filed against the defendant on November 20, were products of a preliminary investigation, adding that the charges would still be amended considering the new fact that have emerged during further investigation.
In his ruling, Justice Halilu held that the defence should file a formal application in that regard, and therefore adjourned.
