Breaking: Appeal Court upholds Gumau’s election as Senator in Bauchi

The Court of Appeal Jos division, Friday morning dismissed an appeal against Senator Lawal Yahay Gumau of All Progressives Congress (APC).

Hon. Garba Dahiru of the People’s Democratic Party (PDP), had challenged the returned of Senator, Lawal Yahaya Gumau, as Senator of Bauchi South district, by INEC. 

The court in a lead and consensus judgement, delivered by Justice Mrs. Ukechuku Onyemenam, held that the appellant had filed his briefs beyond the stipulated time provided by the electoral act and the laws.

“The court held that no competent appellant briefs before it, it is therefore struck out, having been filed beyond 10 days as provided by the election tribunal act and other laws,” she hold.

She said the issues of jurisdiction as raised by the 1st respondent, can be raised at any stage of court proceedings.

“I dismiss the appeal having the appellants no briefs before the court. The election of the 1st respondent is upheld,” she ordered.
