Breaking: Jika floors Misau at Appeal, remains in Senate

The Court of Appeal, Jos division has upheld the election of Senator Dahiru Dauda Jika of the All Progressives Congress (APC) into Bauchi central senatorial district in Bauchi State.

In a unanimous judgement led by Justice Mudaseer Oniyangi, the court  dismissed appeal No. CA/J/ETP/NASE/BA/367/2019, filed by Hon. Bappa Aliyu Misau.

He said the tribunal erred to have held that grounds one and two of the petitioner/appellant, were preelection matters, going by section 138 of the electoral act.

Justice Oniyangi held that the appellant has failed to proved that in either of the dates of birth presented to the Independent National Electoral Commission (INEC) by Senator Jika, was below the required age of 35 years.

Justice Oniyangi further held that since there was no evidence that proved Senator Jika’s diploma certificate of Kaduna polytechnic was forged even as the school didn’t disown the certificate.

He then disallowed the appeal and upheld the election of Senator Dahiru Jika.
