Court remands man, 44, for alleged robbery in Osun


A Magistrate’s court, sitting in Ile-Ife, Osun state, Thursday remanded a 44-year-old man, Elugbindin Timothy, for alleged armed robbery.  


The prosecutor, Mr. Joseph Adebayo, alleged that the defendant committed the purported crime on March 10, 2020, around 5:00am at Odemuyiwa Village via Ifetedo.


The prosecutor alleged that the defendant conspired with others, now at large, to commit felony to wit armed robbery. 


He told the court that the defendant armed himself with gun and other dangerous weapons and robbed one Fatai Adeyeni of 50 gallons of palm oil and 2 bags of cocoa beans.


He stated that the defendant also stole 3 bags of palm kernel seeds, goats and hospital equipments, total valued N10 million.
The prosecutor said that the defendant willfully set the dwelling house of his victim, Chief Fatai Adeyeni ablazed. 


According to the charge sheet, the alleged crime contravened the provision of sections 1 (1) and 6(b) of the Robbery and Firearms (Special Provisions) Act Cap R11, Laws of Nigeria, 2004.


The charge in another count contravened sections 1(1), (2), (a), (b) and 443 of the Criminal Code Cap 34, Vol II, Laws of Osun, 2002.


Counsel to the defendant, Mr. Obi Samuel, was not allowed to apply for the bail as the Magistrate refused to take the plea of the defendant. 


The Magistrate, Joseph Owolawi, said his court lack jurisdiction to hear the armed robbery case being a capital offence. 


He ordered that the defendant be remanded at the State Criminal Investigation Intelligent Department (SCIID) and adjourned the case to June 24, for mention.
