Court remands man for unlawful possession of firearms

A Magistrates’ Court sitting in Modakeke, Osun state, Thursday remanded a 28-year-old man, Sunday Olatunji in prison, for unlawful possession of fire arms.

The prosecutor, Mr Ona Glory, told the court that the accused committed the crime on August 8, 2019 around 8:30am, along Famia road, Modakeke-Ife.

He alleged that the accused armed himself with one locally made pistol loaded with cartridge in a public place and caused pandemonium in the community.

The prosecutor said the accused could not give satisfactory account of how he got the locally made gun.

The prosecutor said the offences contravened sections 80 of the Criminal Code Cap 34, Vol 11, Laws of Osun and  3(1) of the robbery & Fire Arm Special Provision R11, Laws of the Federation, 2015.

The accused pleaded not guilty to the two-count charge of possession of fire armed and breach of peace.

Counsel to the accused, Mr Sunday Unah, urged the court to grant the accused bail in the most liberal term. He said the accused would provide reliable sureties if granted bail.

Magistrate Abimbola Famuyide refused the bail of the accused, on the ground that her court lacks jurisdiction to try Robbery & Fire Arm case.

Famuyide asked the prosecutor to duplicate the case file of the defendant to the office of the Director of Public Prosecution (DPP) for legal advice.
