Court remands yahoo boy, directs EFCC to produce American victim

Justice Peter Lifu of a Federal High Court sitting in Osogbo, the capital of Osun state, has ordered the remand of Adedayo Adeyinka for alleged cyber crime. 


The accused was alleged to have claimed to be Amanga Kizrow, a name he used to defraud many of his victims who are Americans.  


He had entered into plea bargain with the Economic and Financial Crimes Control,  EFCC, and agreed to forfeit the proceed of his loot to the federal government. 


When he was showed the plea bargain agreement and asked whether he was forced or promised soft landing by anyone, the accused replied no. 


The presiding judge asked for the proof to show that the Attorney General of the Federal is aware of the plea bargain. The prosecution could not provide it. 


Justice Lifu thereby insisted that Section 270 (28) of the Administration of Criminal Justice Act provides that a copy of the plea bargain must be sent to the AGF. 


Meanwhile, the prosecutor, Mr AbdurRasheed Sulaeman, explained that the commission has done everything necessary on the matter. 


A witness from the EFCC, Mr. Bello Babatunde, had tendered a car key, a cheque of almost N200,000 and some documents  purportedly seized from the accused. 


The EFCC urged the court to order forfeiture of the car, which he said has been kept in the custody of the commission, to the federal government and the cheque to the EFCC for transfer to the owner. 


But, Justice Lifu maintained that Section 270 (13) of ACJA must be obeyed. According to the Judge, the cheque must be transfered to the victim or his representative or other person lawfully entitled to it. 


The explanation of the prosecution that the commission is in talk with the FBI to return the money to the victim does not convince the judge as Justice Lifu ordered that the accused be remanded in correctional facility and adjourned the natter to November 15, 2019.


One of the accused, Oyelude Opeyemi, informed the court that he was struggling to pay the 5,500USD.  


Also, one Ajao Ololade, informed the court that he has raised substantial part of the 1,641USD to fulfill the plea bargaining.
