Court squashes N302m theft case against Kent

An FCT High Court Judge, Justice Sylvanus Chinedu Oriji, has      quashed a 302million naira theft and forgery case preferred against Mohammed Abubakar Kent and one Precious Otsu.

The Economic and Financial Crimes Commission (EFCC) through a complaint from Arch. Sulaiman Aliyu of Little Acorns Turnkey Projects Ltd., dragged the two defendants before the court on a two count charge of theft and forgery.

Justice Oriji in a judgement he entered on 26th April, 2018, a copy, which was obtained by BLUEPRINT over the weekend in Abuja, averred that he discontinued the case following the withdrawal of the suit by its nominal complainant.

Presiding over the law suit NO FCT|HC|CR|109|2014, the trial judge held that the nominal complainant, Architect Sulaiman Aliyu had written an application to discontinue the suit he filed at the Federal High Court through the EFCC which was dated 14|2|2017.

The presiding judge also held that: “where a complainant, at any time before a final order is made in a case, satisfies the court that there are sufficient grounds for permitting him to withdraw his complaint, the court may permit him to withdraw the complaint and shall thereupon acquit the defendant.

“The court, pursuant to Section 355 of ACJA, 2015 hereby permits the nominal complaint to withdraw the complaint upon which the charges against the defendants were based. The defendants are hereby acquitted,” Justice Oriji ruled.
