Ekiti murder: Man to die by hanging

An Ado-Ekiti High Court has sentenced a 30-year-old man, Mayowa Omolaye, to death by hanging for the murder of one Mr. Tayo Oluwabusuyi.
Omolaye, an ex convict, was charged with the murder of Oluwabusuyi at Igbooroke farm in Igede-Ekiti, headquarters of Irepodun/Ifelodun local government area of the state, on May 30, 2009.
It was gathered that Omolaye had earlier been convicted of assault and stealing from the same farm, where he was said to have robbed the same Oluwabusuyi.
After serving his jail term at the Ado-Ekiti prison, he allegedly returned to Oluwabusuyi’s farm, where he hacked him to death with cutlass.
The deceased, a 56-year-old farmer, was a retired dispatch rider for one of the first generation banks in the community.
The prosecution had contended that the act contravened Section 316 of the Criminal Code Act, Cap 38, Laws of the Federal Republic of Nigeria, 2004.
According to the prosecution, Omolaye had confessed to the crime, and had claimed to have slit the throat of his victim.
While sentencing the accused, the trial judge, Justice Lekan Ogunmoye, held that where the essential ingredients of the offence charged had been proved “as has been done in this case, the charge is proved beyond reasonable doubt.”
“The judgement of this court is that you be hanged by the neck until you are dead and may the Lord have mercy on your soul.”
