Gang leader to die by hanging over land dispute

A Kogi state High Court, yesterday, sentenced a leader of a six-man gang, Mohammed Sani Audu, to death by hanging for stabbing one Hussein Isa to death over land dispute.

The convict, who hails from Adavi local government area of the state, was charged with Culpable Homicide punishable with death contrary to section 221(a) of the Penal Code Law.

Audu, according to the prosecution, had led a six-man gang to a land which was in dispute between the families of the deceased and one of his gang members, Momoh-Jimoh Abaniki, when late Isa challenged their presence on the land and objected to its demarcation for the purpose of selling it.

The deceased was said to have returned home to tell his brother, Ozovehe Isa and other family members what transpired on the farm but the convict came to his house to challenge him.

Thereafter, altercations ensued and the convict stabbed the deceased and inflicted severe injury on his head while other members of his gang kicked out late Isa, which resulted to his death the following day in a hospital.

In his judgement, the trial Judge, who is also the Chief Judge of the state, Justice Nasir Ajanah, held that the prosecution had proved its case beyond reasonable doubt and convicted the accused accordingly.

“The sentence of the court upon you, Mohammed Sani Audu, is that you be hanged by the neck until you are certified dead or by lethal injection,” the CJ pronounced.
