Gbajabiamila: Court adjourns, set to accommodate defendant response June 14

A Federal High Court sitting in Abuja Friday, reiterated its readiness to accommodate defendant response in the suit filed against Femi Gbajabiamila, a member of the House of Representatives.

 The court has therefore adjourned the case till June 14 for further mention

Gbajabiamila who was accused of facing criminal charge in the United States of America was sued in a suit with No. FHC/ABJ/CS/539/2019,  by one Philip Undie, a Businessman on the ground that he has a criminal case to answer in the state of Georgia, US.

Undie is equally challenging the eligibility of Gbajabiamila, one of the leading contenders vying for the position of speaker in the incoming 9th House of Assembly.

Other respondents/defendants in the suit are the House of Representatives, Attorney General of the Federation (AGF) and the All Progressives Congress (APC) respectively.

At the resumed sitting on the suit, defendant counsel, Mr Adebowale Kamoru, informed the court that he has just been served with court process this morning.

Kamoru therefore pleaded with the court to grant an adjournment to enable him study the process since he was newly served this morning.

“We have undertake to collect the service of the originating process on behalf of the first defendant, the first defendant has now been served. We will study the process and respond appropriately.

Earlier, the plaintiff counsel, Mr Olasupo Azeez, informed the court that there was a pending application of the plaintiff seeking for the leave of the court to serve the defendant the originating process.

“The second respondent was served on May 31, we apply to withdraw the motion exparte in this matter having been undertaken by event

“We also urged the court to refused the applicant party seeking to be join in the suit on the ground that they have not shown why they are seeking joinder in this matter,” Azeez prayed.

Justice Ekwo however granted the adjournment at the instance of the counsel and has since adjourned the suit till June 14 for further mention.
