Haulage pact: DANA faces court contempt over subpoena

A Minna High Court has issued form 48, the first stage of contempt of court process, against DANA Pharmaceutical Company in Minna for disobedient of its subpoena to produce haulage documents in its possession in a case involving its business partners instituted at the court.

The court, according to documents made available to Blueprint Weekend, has subpoenaed the company, its general manager, accountant and the factory manager to produce in court documents in their possession requested for by the plaintiff in a suit no NSHC/MN/248/2017 between Emaka Eleje as plaintiff and Alhaji Usman Dansabo and ADL Motors Nig. Ltd. as defendants.

The subpoena issued on July 25, 2020, also summoned and commanded the company and the affected officials to attend in person before the court to testify all they know in the said case.

They were required to produce documents of the original copy of the 1st transport agreement entered between DANA Pharmaceutical Ltd and ADL Motors Nigeria Ltd in 2010 – 2011, the certified copies of all the transport agreements between DANA and ADL companies from 2011 to date including the computer printout of the records of all the payments made to the ADL motors Nig. Ltd from 2010 till date.

However, counsel to the plaintiff, Gavers Ihematulam, told our correspondent that the contempt of court process was initiated due to flagrant disobedience to the court order by the company adding that form 49 will soon be initiated if the company does not heed the warning of the court.
