Kaduna central: Tribunal validates Uba Sani’s victory, dismisses PDP’s Lawal Usman petition

The Kaduna State National and State Assemblies Election Petitions Tribunal has thrown out Peoples Democratic Party’s candidate, Lawal Adamu Usman’s petition challenging the victory of Uba Sani in the Kaduna Central Senatorial election.

The Tribunal, sitting at the Kaduna State High Court, on Saturday validated the victory of Senator Uba Sani as the elected Senator representing Kaduna Central Senatorial Zone, having earlier dismissed a similar petition by Senator Shehu Sani of the Peoples Redemption Party (PRP).

Delivering the judgment, Chairman of the Tribunal, Justice A.H Suleiman, said that the petition argued by Lawal Usman’s lawyers could not be sustained on the strength of the evidences adduced. 

The Tribunal rejected as invalid all evidences tendered by the petitioner, noting that the evidences failed to prove any of his allegations of corrupt practices, over voting and election violence and election malpractices.  

Justice Suleiman while throwing out the petition said the bulk of the evidences presented by Lawal Usman hinged on hearsay, adding that all his witnesses depositions were of hearsay, which is not admissible in law. 

The Tribunal had last week Wednesday struck out a similar petition against Uba Sani by ex-Senator Shehu Sani for lack of merit. But the former senator said that the judgment was miscarried and justice was not served, hence vowing to appeal the judgment. 

The Independent National Electoral Commission (INEC) had declared in February that Uba Sani polled 355, 242 votes to win the Kaduna Central senatorial election, while Lawal Usman scored 195, 497 votes to place second and Senator Shehu Sani came third with 70, 613 votes.
