The Jos division of Federal High Court, has adjourned the pre-election suit, filed by a governorship aspirant, Danyaro Dakon Sarpiya, against the All Progressives Congress (APC) and the Independent National Electoral Commission (INEC), challenging the nomination of Nentawe Yilwatda as governorship candidate of the 1st respondent.
The plaintiff’s counsel, S.A. Abbah esq, urged the court to grant him leave to amend their exparte motion to join the APC candidate Nentawe Yilwatda, in the suit filed through an originating sermons.
“My lord, I move a motion exparte seeking the leave of the court to allow us, amend our originating summons to join the candidate in the suit,” he prayed.
He told the court that the initial parties in the matter were yet to be served with the process.
Mr. Matthew Burkaa SAN, told the court that he had a motion pending before it, wanting to announce appearance for Nentawe Yilwatda, but S.A. Abbah objected to the appearance of the learned silk on the ground that he is not a party to the suit as the business of the day was for the hearing of the applicant motion exparte for an order of the court to amend his originating process.
The court agreed with the position of the applicant’s counsel and refused to enter appearance for the learned silk’s appearance as his client in person of Dr. Nentatwe Yilwatda Goshwe, the APC gubernatorial flag bearer in the recent party primaries was not made a party to the suit who by so doing would be seen as a meddlesome interloper.
Barrister Abbah said order 7 of the High Court was clear.
The court presided over by Justice Dorcas Agishi, granted Mr S.A. Abbah’s prayer to amend his originating process.
Justice Agishi, ordered that all processes should be served on the parties before the adjourned date, after which the matter was adjourned to the 20th September, 2022 for hearing.
