Presidential election: Tribunal dismisses PDM petition seeking poll cancellation, Buhari’s victory

The Presidential Election Petition Tribunal (PEPT) on Wednesday quashed the petition filed by the Peoples Democratic Movement (PDM) and its presidential candidate, Pastor Aminchi Abu, challenging the victory of Muhammadu Buhari at the February 23, 2019 poll.

Habu and his party, PDM, had in their petition number CA/PEPT/ 04/2019 filed on March 19, 2019 sought the nullification of the February 23 presidential poll on grounds that they were excluded from participating in the election.

PDM petition is one of the three remaining petitions filed before the tribunal to challenge the outcome of the February 23 2109 election.

The PDM and its candidate had brought its petition on the ground that the party was excluded from the ballot papers for the presidential election.

Meanwhile, in an application filed by the petitioner’s lawyer, Aliyu Lemu, he told the Justice Garba-led five man panel that his client has given him directive to withdraw the petition.

His request which came on the day they were suppose to open their case was not objected to byCounsel to the Independent National Electoral Commission INEC), Yunus Usman, President Buhari’s Yusuf Alli, and the APC did not oppose the withdrawal and the All Progressives Congress (APC) who are all respondents in the suit.

Subsequently, the tribunal unanimously dismissed the petitions following the withdrawal.
